You bought an iPhone 16. Maybe a 15 Pro. You wanted the AI magic Apple promised.
It never arrived on day one.

A class-action lawsuit over false advertising has reached a preliminary settlement. The payout? Up to $250 million shared among eligible buyers. But here is the catch. You aren’t getting checks in the mail next week.
Wait until late 2027.
Why Apple Settled the Apple Intelligence Delay Lawsuit
Back in September 2024, Apple made a big deal about Apple Intelligence. The marketing screamed “advanced Siri” and “AI agents.”
The phones launched. The software did not.
Apple Intelligence features trickled out in iOS 18.1 five weeks later. And even then? They weren’t the big ones.
The lawsuit alleged that Apple saturated the market with deceptive ads. Specifically, they induced consumers to buy expensive hardware based on software promises that were vaporware at launch.
Visual Intelligence and Writing Tools showed up eventually. Sure. But the heavy lifting the ads hyped? That’s still coming.
“Apple allegedly saturated the market with deceptive Ads, inducing consumers to purchase iPhones based on promise of certain enhanced Siri features,” the settlement documents state.
The real AI agent capabilities Apple advertised are supposedly arriving in iOS 26 (often referred to as the next major iteration). We are looking at public betas now. But for the people who bought in 2024? They waited. And now Apple is paying for it.
An Apple spokesperson told CNET they reached this settlement to stay focused on products. Standard corporate deflection. But the court agreed the terms were sufficient to move forward as of July 17.
Which iPhone Models Qualify For The False Advertising Payout
Not every phone counts. Only devices bought during a specific window qualify for the Apple AI settlement payout.
The window runs from June 10, 20204, to March 29, 25.
Here is the list of eligible devices:
- iPhone 16
- iPhone 16 Plus
- iPhone 16 Pro
- iPhone 16 Pro Max
- iPhone 16E (yes, this one counts)
- iPhone 15 Pro
- iPhone 15 Pro Max
Note that base iPhone 15 models are excluded. Only the Pro versions had the hardware chops for the features in question.
Estimates suggest about 36 million customers might be eligible.
Per device, the payout ranges from $25 to $95.
Is it life-changing? No.
Is it free money for waiting on beta software? Yes.
How To Claim Your Apple AI Settlement Payment
Right now? Do nothing.
You cannot file a claim today.
Apple must first provide a list of eligible customers to the settlement administrator. They have five days from court approval to do this. Preliminary approval came in late July. So the data hand-off should happen soon.
Once the administrator (Verita) gets the data, they verify it. Then notices go out.
Via email. Via post.
You will receive an instruction on where to go. There is no settlement website yet. It will be created when needed.
Once you get the notice, the clock starts.
You have 90 days to file your claim.
When Will You Receive The Money
Patience. A lot of it.
The court granted preliminary approval in July 2024. The final approval hearing is set for the morning of September 2, 2027.
If the judge says yes then:
The payout phase begins.
Checks or direct deposits will arrive within a 60-day window after that final approval.
So, October 2027 is the earliest realistic target.
Why so long?
Legal bureaucracy.
Verifying millions of purchases.
Processing claims.
The 45-day notice period starts after the data is verified. Then the 90-day claim window opens. Then the court takes its time.
It feels arbitrary. A year and a half for a software delay?
Probably. But that is the timeline.
Keep an eye on your email in mid-2025. And remember to check your junk folder. You don’t want to miss the notice because you ignored a spam-looking email.
